A boy who was intentionally burned did not live long enough to see his alleged killer charged for any crime.
28-year old Don Collins of Texas is facing a charge of first degree murder for a 15-year old incident in which he allegedly tied eight-year old Robert Middleton to a tree, doused him with gasoline, then set him on fire.
The boy had third-degree burns over 99% of his body and finally died in 201 of cancer doctors attributed to the burns.
Middleton testified that Collins sexually assaulted him before he was burned; an attorney for the case claimed that other children have stated that Collins assaulted them and threatened to burn them if they ever told anyone.
ABC Local reports that a judge must decide if Collins can be tried as an adult, since he was a child at the time of the attack but the death he caused occurred when he was a grownup.
